Property Division in California

California is a community property state. This means that any assets and debts acquired during a marriage belong equally to the spouses and are divided equally upon divorce. Couples have the choice of making their own agreement as to property division or requesting the court divide their assets and debts on their behalf.

Community Property Versus Separate Property

To divide property in a divorce, the property must be identified as community (marital) or separate (individual). In California, there is a presumption that property accumulated by a couple during a marriage is community property. Separate property belongs to the spouse who owns it and is not generally divided in a divorce.

Separate property in California includes property one spouse owned alone before the marriage or acquired by gift or inheritance during the marriage. It also consists of the following:

  • Items purchased with or exchanged for separate property;
