Establishing Parentage in California

To establish parentage in California, an unmarried father must obtain a court order or sign an official Declaration of Paternity declaring he is the child’s legal father. Even if a father can prove he is the biological father of a child, unless he was married to the mother at the time of the child’s birth, he does not legally have any rights or responsibilities for the child.
